End User Lisense Agreement (EULA) & Acceptable Use Policy

1 min read

1. Overview & License Grant Scope #

This End User License Agreement (EULA) and Acceptable Use Policy (AUP) establish the legally binding terms governing access to and usage of the BEX network software, client core, and gateway infrastructure. BEX grants the end-user a limited, non-exclusive, non-transferable, revocable license to utilize the client software and routing network strictly in accordance with these terms. This license does not convey ownership rights, intellectual property, or reverse-engineering privileges to the underlying software binaries or network architectures.

2. Acceptable Use Policy (AUP) Restrictions #

To maintain network integrity, high availability, and IP reputation across global gateway clusters, users are strictly prohibited from engaging in the following illegal or abusive activities via the BEX infrastructure:

  • Cyberattacks & Network Abuse: Execution of Distributed Denial of Service (DDoS) attacks, port scanning, vulnerability probing, or operating automated botnets.
  • Malicious Software & Spam: Transmission of malware, ransomware, phishing material, or sending unsolicited bulk commercial email (SPAM) violating global anti-spam regulations.
  • Unauthorized Commercial Reselling: Reselling, renting, or leasing individual consumer access tokens outside the authorized B2B Reseller Partner framework.
  • Infrastructure Interference: Attempting to bypass concurrent device limits, tamper with client TUN interfaces, or manipulate eBPF billing counters.

3. Account Responsibilities & Credential Security #

End-users are solely responsible for maintaining the confidentiality and security of their access credentials, cryptographic keys, and subscription tokens:

  • Credential Protection: Users must prevent unauthorized third-party access to their client configuration files and private keys.
  • Immediate Notification: Users must immediately revoke or re-issue tokens via the BEX dashboard if credential compromise or unauthorized device association is suspected.
  • Liability for Compromise: Any activity conducted through a validly authenticated token is legally attributed to the account holder until explicit revocation is registered.

4. Limitation of Liability & Indemnification #

To the maximum extent permitted by applicable law:

  • As-Is Provision: BEX services and client software are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, explicit or implied.
  • Indirect Damage Disclaimer: BEX disclaims all liability for indirect, incidental, consequential, or punitive damages, including data loss, business interruption, or third-party service blocking.
  • Indemnification: Users agree to defend, indemnify, and hold harmless BEX, its operators, and B2B reseller partners from any claims, legal liabilities, or expenses arising from violations of this AUP.

5. Key Strategic & Legal Benefits #

  • Infrastructure Protection: Clear AUP rules provide strict legal grounds for isolating and terminating abusive accounts.
  • Liability Boundary: Protects BEX operators and reseller partners from third-party end-user actions.
  • Enforceable License Framework: Defines explicit operational parameters for client binary deployment across platforms.
